Mysttaks Terms of Service

Welcome to Mysttaks! These Terms of Service ("Terms") govern your use of the Mysttaks platform ("Platform"), which connects businesses and content creators for sponsorship opportunities. By using our services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using the Mysttaks platform, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Platform.

3. Responsibilities of Mysttaks

Mysttaks provides the platform to facilitate connections between businesses and content creators. We do not directly engage in the content creation, negotiation, or fulfillment of sponsorship deals. We offer the following:

• • Approval of Deals: We reserve the right to approve whether a sponsorship deal has been executed correctly based on the proof provided by the content creator and business. Our decision to approve is final and binding.
• • Sponsorship Deal Confirmation: Once we have reviewed the evidence of sponsorship completion, including but not limited to performance metrics, campaign details, and content creator deliverables, we will approve the deal if we find it has been completed according to the terms agreed by the business and content creator.

4. Liability for Deal Approval

Mysttaks' approval of deal completion does not guarantee satisfaction from either party. By using our Platform, both businesses and content creators agree that Mysttaks is liable only for verifying the completion of the deal as per the agreed-upon terms. We are not liable for any dissatisfaction resulting from performance or outcomes related to the content creator’s promotional content.

You agree to hold Mysttaks harmless from any legal action, claims, or damages that may arise if you are dissatisfied with the results of a sponsorship, after Mysttaks has approved the deal completionn based on provided evidence.

• • Approval Process:Mysttaks will review all submitted proof (such as video content, engagement metrics, and other relevant data) within a reasonable timeframe. If the provided proof does not meet the expected criteria, the deal will not be approved.
• • Dispute Resolution: If a business is dissatisfied with a sponsorship deal after our approval, Mysttaks will assist in resolving any issues where possible, but we do not assume liability for dissatisfaction regarding performance, results, or the effectiveness of the content created. All disputes will be handled per the dispute resolution procedures outlined in Section 10.

5. Satisfaction and Liability

Mysttaks is a third-party facilitator. We are not involved in the direct execution of the sponsorship deal, nor do we take responsibility for the satisfaction of either party with respect to the actual content or the deal's outcome.

• • No Liability for Dissatisfaction: In the event that either the business or the content creator is not satisfied with the outcome of the sponsorship or the performance of the other party, Mysttaks will not be held liable. By using the platform, both parties acknowledge that Mysttaks is not responsible for any actions, dissatisfaction, or consequences arising from the completed sponsorship deal. Mysttaks acts solely as an intermediary to facilitate connections and approvals based on the information submitted by both parties.

6. User Responsibilities

• • For Businesses:You are responsible for providing accurate and clear details about the sponsorship offer, including deliverables, timelines, payment, and content specifications. Businesses must ensure that the content creator receives clear communication and approval from you before submission.
• • For Content Creators: Content creators must fulfill the terms of their sponsorship offers and provide proof of completion to Mysttaks, including relevant content and engagement metrics. Failure to do so may result in non-approval of the deal completion.

7. Content Ownership

Businesses retain ownership of their intellectual property (IP), including logos, products, and branding. Content creators retain ownership of their original content. However, content creators grant Mysttaks a license to use the content solely for verification and promotional purposes related to the sponsorship deal.

8. Fees and Payment

• • Platform Fees: Mysttaks charges a commission on successful sponsorship deals. This fee is detailed in the platform's pricing page and is subject to change with prior notice.
• • Payment Terms: Businesses agree to make timely payments for accepted sponsorship offers as per the agreed terms. Payments are handled via the Platform, and Mysttaks will facilitate the transfer between businesses and content creators, minus applicable fees.

9. Termination

• • By You: You may terminate your account and access to the platform at any time, subject to the termination of any active deals and the resolution of any pending payments.
• • By Mysttaks: We reserve the right to terminate or suspend your account for violation of these Terms, fraudulent activity, or abuse of the platform. In such cases, Mysttaks may withhold payments or deal approvals at our discretion.

10. Dispute Resolution

• • Arbitration: In the event of a dispute arising out of or relating to these Terms, the parties agree to attempt to resolve the dispute amicably before resorting to formal proceedings. If a resolution cannot be reached, the parties agree to submit the dispute to binding arbitration in accordance with the rules of [chosen arbitration body].
• • Jurisdiction: These Terms are governed by the laws of [your jurisdiction], and any disputes will be resolved in the courts located in [your jurisdiction].

11. Modifications to the Terms

Mysttaks reserves the right to modify these Terms at any time. Any modifications will be posted on this page with an updated "Effective Date." Continued use of the platform after changes are posted constitutes acceptance of the modified Terms.

12. Limitation of Liability

To the fullest extent permitted by law, Mysttaks’ liability is limited to the amount of fees paid by the user for the use of the platform, and we are not liable for any consequential, indirect, special, or punitive damages resulting from the use of the platform or the execution of sponsorship deals.

13. Proof Submission and Rejection

Mysttaks reserves the right to review and reject proof submitted by content creators as many times as necessary to ensure that the deal requirements are upheld and that both parties (business and content creator) have fulfilled their respective obligations as outlined in the sponsorship agreement.

• • Review Process:Upon receiving proof of deal completion (such as content, performance metrics, or other relevant documentation), Mysttaks will assess whether it meets the agreed-upon standards. If the proof does not meet these standards, Mysttaks may reject the submission and request a revised version.
• • Rejection Rights: Mysttaks may reject proof for non-compliance with any aspect of the sponsorship agreement, including but not limited to content quality, delivery timelines, performance metrics, and other specified deliverables.
• • No Limit on Rejections: Mysttaks reserves the right to reject the proof repeatedly until it is satisfied that the business’s requirements and the content creator’s obligations have been fully met. This is in order to ensure that the deal is completed according to the agreed terms and to protect both parties involved in the sponsorship.
• • Final Approval: Mysttaks' approval of proof will be contingent upon a thorough review and satisfaction with the content and deliverables submitted. Businesses and content creators agree that Mysttaks’ decision regarding the acceptance or rejection of proof is final for the purpose of deal completion verification
